CDR Appeals Procedure - Students
In accordance with Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act (ADA), the ADA Amendments Act (ADAAA), and Delaware State University’s commitment to equal access for people with disabilities, an appeal process has been established for students who believe they have been denied reasonable accommodations by the Center for Disability Resources (CDR).
If there is a dispute as to whether a student has a disability or whether the documentation provided is adequate, if the CDR Representative and the student with a disability cannot agree on a reasonable accommodation, or if the CDR denies an accommodation, the student may begin the appeals process.
In the event the Student Accommodations Coordinator within the CDR made the accommodation decision, the University has identified the Director of the Center for Disability Resources and ADA and Section 504 Compliance Officer, by whom all appeals for reasonable accommodations will be reviewed.
In order to initiate this process, the student must submit a written Letter of Appeal to the appropriate party within thirty (30) calendar days of the alleged denial, unless extensions for good cause are provided.

The Letter of Appeal must include:
- Name and University ID number of appellant
- Basis for the appeal
- The remedy or relief sought
- Any supporting information
Upon receipt of the Letter of Appeal, all materials will be promptly reviewed. A determination will be provided to the appellant in writing within ten (10) business days.
If the Director of the CDR made the original accommodation decision, the University has identified the Chief Enterprise Risk Officer and Chief General Counsel, Ms. LaKresha Moultrie, J.D. (or her designee) as the individual by whom the appeal will be reviewed. Such Letter of Appeal can be sent to the Office of General Counsel, 1200 N. DuPont Highway, Dover, DE 19901 or lmoultrie [at] desu.edu. The above review and response process would still apply.
